Terms of Service

Introduction

These Terms of Service govern your access to and use of SPXGEXHeatmap.com, including our public pages, member-only pages, charts, dashboards, educational materials, account features, and related services. By visiting the site, creating an account, signing in, or using any part of the service, you agree to these Terms. If you do not agree, do not use the site.

References to "we", "us", "our", and the "Site" mean SPXGEXHeatmap.com and the people or systems that operate it. References to "you" mean the visitor, registered user, customer, or other person using the Site.

1. General Terms

You may use the Site only if you can form a binding agreement under applicable law. You are responsible for complying with all laws and rules that apply to your use of the Site. You may not transmit malware, attempt to bypass security, interfere with the Site, or use the Site in a way that harms other users or our systems.

We may change, limit, suspend, or discontinue any part of the Site at any time. We may also restrict, suspend, or terminate access if we believe a user has violated these Terms, created risk for the Site, abused the service, or used the service in a prohibited way.

2. Accounts and Verification

Some pages or tools require registration, email verification, Google sign-in, password login, or administrator approval. You agree to provide accurate account information and to keep your login credentials secure. You are responsible for activity that occurs through your account unless you promptly notify us of unauthorized access.

You may not sell, share, sublicense, transfer, or assign your account. We may disable accounts that use false information, automated signups, temporary email abuse, credential sharing, payment abuse, or other behavior that we consider harmful to the Site or other users.

3. Educational Use Only

The Site provides market-structure analytics, GEX heatmaps, option-flow summaries, roadmap-style visualizations, and related educational content. The Site is for informational, educational, and research purposes only. Nothing on the Site is financial advice, investment advice, trading advice, tax advice, legal advice, a recommendation, an offer, or a solicitation to buy or sell any security, option, futures contract, ETF, index product, cryptocurrency, or other financial instrument.

You are solely responsible for your own investment and trading decisions. You should consult qualified financial, legal, tax, and investment professionals before making decisions involving risk.

4. Market Data and Analytics Limitations

Data, calculations, charts, and analytics shown on the Site may be delayed, incomplete, stale, interrupted, inaccurate, filtered, approximated, or changed without notice. Our dashboards may use derived, aggregated, estimated, or transformed information. The Site is not an exchange, broker-dealer, investment adviser, OPRA quote service, official market-data feed, or execution platform.

Because market data must be downloaded, processed, calculated, uploaded, and rendered in the web dashboard, information displayed on the Site may appear with approximately a 30-second delay, and at times may be delayed further due to data-provider, network, server, browser, or calculation conditions.

Do not rely on the Site as your only source of market information. Always verify prices, quotes, volumes, open interest, option chains, and other market data through independent sources before taking action.

GEX, DEX, DAGEX, VEX, CEX, gamma-flip levels, dealer-positioning interpretations, flow classifications, trade-direction labels, and similar analytics are derived estimates or model-based interpretations. They are not observed dealer inventory, confirmed order intent, guaranteed support or resistance, or a prediction of future price direction. Different providers, assumptions, timestamps, data inputs, and calculation methods may produce materially different results.

Prices, quotes, spreads, liquidity, open interest, implied volatility, and execution conditions can change rapidly. Any alert, chart, level, or displayed value may be stale by the time it is viewed or acted upon. Actual trade prices and results may differ materially because of bid-ask spreads, liquidity, slippage, commissions, partial fills, market volatility, system delays, order size, and other market conditions. We do not guarantee that any data, dashboard, alert, notification, email, or other communication will be delivered, received, timely, complete, uninterrupted, or error-free.

5. Service Interruptions and Force Majeure

The Site may be temporarily unavailable, delayed, degraded, or suspended due to internet outages, power failures, hardware failures, software defects, cyber incidents, cloud or hosting-provider disruptions, data-provider or exchange interruptions, maintenance, market events, regulatory actions, natural disasters, or other events beyond our reasonable control. During any such event, data collection, calculations, alerts, publication, and dashboard updates may stop, be delayed, incomplete, stale, or unavailable. We do not guarantee uninterrupted operation or recovery within any specific time period and are not responsible for any loss, trading decision, missed opportunity, or damage arising from such interruptions.

The Site depends on third-party data, market infrastructure, hosting, authentication, payment, analytics, and communication providers. These providers may delay, revise, restrict, interrupt, or discontinue their services or data. We do not control and are not responsible for their availability, accuracy, completeness, timeliness, or conduct.

6. Trading Risk

Trading options, equities, futures, ETFs, indexes, and other financial instruments involves substantial risk. You can lose some or all of your capital. Past performance, historical levels, chart patterns, GEX levels, flow readings, or educational examples do not guarantee future results. We do not guarantee profits, loss avoidance, market timing, execution quality, or suitability for any user.

7. Acceptable Conduct

You agree not to use the Site to upload, transmit, post, or distribute unlawful, abusive, deceptive, defamatory, infringing, obscene, threatening, harassing, or harmful material. You also agree not to impersonate another person, misrepresent your affiliation, scrape user data, interfere with networks, bypass rate limits, or use the Site in violation of securities laws, exchange rules, export rules, sanctions rules, or other applicable law.

8. No Scraping, Copying, or Redistribution

You may not scrape, crawl, harvest, mirror, frame, copy, reproduce, retransmit, redistribute, sell, license, publish, publicly display, resell, or commercially exploit any part of the Site, including data, charts, calculations, screenshots, software, page designs, educational materials, or derived analytics, unless we give prior written permission.

9. Commercial Use

Unless a separate written agreement says otherwise, access is for your own personal, internal, educational use. Commercial redistribution, paid alert services, Discord or chat-room redistribution, API extraction, packaged resale, or use inside another product is prohibited without written permission.

10. User Submissions and Feedback

If you send us feedback, suggestions, bug reports, ideas, or other submissions, you agree that they are not confidential and that we may use them to improve, operate, promote, or modify the Site without compensation to you. You remain responsible for any content that you submit and must have the rights needed to submit it.

11. Intellectual Property

The Site, including its software, design, text, educational content, charts, visual layout, logos, trade names, data presentation, and original analytics, is protected by copyright, trademark, trade secret, and other laws. Using the Site does not transfer ownership of any intellectual property to you. We grant only a limited, revocable, non-exclusive, non-transferable right to access the Site as permitted by these Terms.

12. Third-Party Marks and Services

SPX, SPY, QQQ, S&P 500, Nasdaq, Cboe, OPRA, ETF names, exchange names, and other third-party names may be trademarks or market identifiers owned by their respective owners. The Site is independent and is not affiliated with, sponsored by, endorsed by, or approved by those owners unless expressly stated.

The Site may link to or integrate third-party services, including authentication, email, analytics, hosting, payment, advertising, or infrastructure providers. We are not responsible for third-party websites, policies, content, products, or services.

13. Digital Services, Billing, and Refunds

Eligible new customers may receive one card-verified WINNERSTOCK Pro trial covering three calendar days. A valid payment method is required. The trial starts immediately after Stripe confirms checkout and ends at the date and time displayed during checkout and in your account. Monthly and Annual subscriptions include the same Pro pages; they differ only in price and renewal period. The free trial covers website Pro pages only and does not include Discord Pro; Discord Pro becomes available after the first successful subscription payment.

At the end of the trial, Stripe will automatically charge the price and renewal interval you selected unless you cancel before the displayed trial end. You may cancel through Profile and the Stripe customer portal. If you cancel during the trial, access remains available until the scheduled trial end and no subscription charge is due. Canceling after a paid renewal takes effect at the end of the then-current paid billing period unless applicable law requires otherwise.

The free trial is limited to one per customer and payment card across Monthly and Annual plans. We may use account, Stripe card fingerprint, device, and network risk signals to prevent repeated or abusive trials. A device or IP match alone is not necessarily grounds for denial. If a payment card has already used the trial, we may cancel the duplicate trial without charging it and offer a regular-price subscription without a trial.

Unless expressly stated otherwise in writing or required by applicable law, all payments are final and non-refundable once completed. Please review the product description, access term, data-delay notice, and plan details carefully before making a payment.

Any subscription or paid access provides access only to the features and content described for the applicable plan, subject to service availability and these Terms. A service interruption, delay, data issue, feature change, or suspension does not create any guarantee of trading performance, uninterrupted access, or compensation for trading losses or missed opportunities, except where required by applicable law.

14. Service Changes and Termination

We may update, suspend, or discontinue any feature, dataset, page, account permission, pricing plan, or access rule at any time. We may terminate or limit access for violations of these Terms, legal requests, security issues, inactivity, fraud, nonpayment, abuse, or other reasons we consider necessary to protect the Site.

15. Warranty Disclaimer

The Site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of accuracy, availability, merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted operation, security, and error-free performance.

16. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for trading losses, investment losses, lost profits, lost data, business interruption, service outages, inaccurate data, delayed data, unauthorized access, third-party conduct, indirect damages, incidental damages, consequential damages, punitive damages, or any other losses arising from or related to your use of the Site.

17. Indemnification

You agree to defend, indemnify, and hold harmless the Site operators, affiliates, contractors, service providers, and team members from claims, losses, liabilities, damages, costs, and expenses, including reasonable attorneys' fees, arising from your use of the Site, your submitted content, your violation of these Terms, your violation of law, or your infringement of another person's rights.

18. Security and Government Requests

We may access, preserve, or disclose information if we believe it is reasonably necessary to comply with law, respond to subpoenas or lawful requests, enforce these Terms, detect or prevent fraud or security issues, protect users, or protect the Site and its systems.

19. International Access

The Site is operated primarily for users who can legally access it. If you access the Site from outside the United States, you are responsible for complying with local law, export restrictions, sanctions rules, securities rules, and any other rules that apply to you.

20. Copyright and Rights Complaints

If you believe material on the Site infringes your intellectual property rights, contact us with a description of the work, the location of the allegedly infringing material, your contact information, and a statement that you are authorized to act. Send notices to info@spxgexheatmap.com.

21. Privacy Policy

Our Privacy Policy explains how we collect, use, store, and disclose information. By using the Site, you also agree to the practices described in the Privacy Policy.

22. Changes to These Terms

We may revise these Terms from time to time by posting an updated version on this page. Your continued use of the Site after changes are posted means you accept the updated Terms.
